Co-operative Matters

The Maharashtra Cooperative Societies Act sets the stage for cooperative housing societies, providing a comprehensive framework for their registration, membership, and functions. Enacted on January 26, 1962, this act outlines the rights and privileges of cooperative societies across Maharashtra. Notably, amendments were introduced on February 13, 2013, in alignment with central mandates, making them effective from February 14, 2013. Under the Maharashtra Cooperative Societies Act, the primary objective of a housing society is to offer its members open plots, flats, and apartments along with shared amenities and services.

Key Voting Rights Under the Act:

  1. Every society member holds a single vote.
  2. Associate members can vote with written consent from a member.
  3. Provisional members are not entitled to voting rights.
  4. In cases of joint members, the first-named person in the share certificate exercises the voting right. If absent, the second-named person assumes the right.
Property Transfers in Co-operative Housing Societies: Members of cooperative housing societies in Maharashtra can transfer their share, rights, title, and interests through registered documents.

Deemed Conveyance in Focus: Deemed conveyance is a crucial concept introduced by the Maharashtra government to address land transfer challenges in housing societies, particularly during redevelopment efforts. This concept allows societies to apply for the conveyance of land to the Deputy District Registrar (DDR) of Cooperative Societies. Upon document verification and hearings, the DDR may grant an order transferring land ownership to the society.
